1. Agreement to Terms
By accessing and using the CAB-X dispatch platform (“Service”), you agree to be bound by these Terms of Service.
CAB-X is operated by CAB-X Software Ltd, a company registered in England and Wales. These Terms govern your use of the CAB-X platform and related services.
If you do not agree to these terms, please do not use the Service.
2. Description of Service
The Service provides a taxi and transportation dispatch management platform, including but not limited to:
- Real-time booking and dispatch management
- Driver and fleet management tools
- Customer relationship management
- Reporting and analytics
- Communication tools between dispatchers, drivers, and customers
- Driver mobile application for iOS and Android
- Passenger mobile application for iOS and Android
- Web booking tools and widgets
- Other features and services made available by CAB-X from time to time
CAB-X provides software tools to assist with taxi and private hire business operations. CAB-X does not provide transport services, employ drivers, or act as a transport operator.
3. User Accounts
To access the Service, you must create an account.
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Ensuring account information is accurate and up to date
- Notifying CAB-X immediately of any unauthorised use of your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription and Payments
The Service is offered on a subscription basis. Current pricing is available on our website.
Subscriptions are billed monthly in advance based on your selected plan, vehicle numbers, and any additional services or add-ons.
Additional services, including optional features such as Web Booker, may incur additional monthly charges.
All fees are exclusive of VAT and applicable taxes unless stated otherwise.
If payment is not received by the due date, CAB-X reserves the right to suspend access to the Service until outstanding balances are paid. A reconnection fee may apply.
Subscriptions continue on a rolling monthly basis unless cancelled.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused periods.
CAB-X reserves the right to change pricing with at least 30 days’ notice.
5. Customer Responsibilities
Customers are responsible for ensuring they hold all required licences, permissions, insurance, and approvals required to operate their taxi or private hire business.
Customers are responsible for ensuring that their drivers, vehicles, and operations comply with all applicable laws and regulations.
CAB-X provides software tools to assist with dispatch and management but does not accept responsibility for customer journeys, drivers, vehicles, passengers, or transport operations.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Service
- Interfere with or disrupt the Service or servers
- Share your account credentials with unauthorised parties
- Use the Service to transmit harmful or malicious content
- Reverse engineer, decompile, or disassemble the software
- Resell or redistribute the Service without written consent
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy.
You retain ownership of all data you input into the Service. CAB-X will not sell customer data or share it except as described in our Privacy Policy or where required by law.
Where CAB-X processes personal data on behalf of a customer, CAB-X acts as a data processor and the customer acts as the data controller where applicable under UK GDPR.
Customers remain responsible for ensuring they have appropriate lawful bases and permissions for any personal data entered into the Service.
8. Third-Party Services
The Service may rely on third-party providers and integrations, including but not limited to mapping services, payment providers, messaging providers, hosting providers, and app stores.
CAB-X is not responsible for interruptions, failures, changes, or limitations of third-party services outside of our control.
9. Intellectual Property
The Service, including software, source code, designs, branding, documentation, and related intellectual property, is owned by CAB-X Software Ltd and protected by copyright and other applicable intellectual property laws.
These Terms do not grant you any rights to our intellectual property except the limited right to use the Service.
10. Service Availability
We aim to maintain reliable access to the Service but do not guarantee uninterrupted availability.
The Service may be temporarily unavailable due to maintenance, updates, security measures, or circumstances beyond our reasonable control.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.
We do not warrant that the Service will always be uninterrupted, error-free, or free from harmful components.
12. Limitation of Liability
To the maximum extent permitted by law, CAB-X shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Service, including loss of profits, business opportunities, data, or other losses.
Nothing in these Terms limits liability that cannot legally be excluded, including liability for fraud, fraudulent misrepresentation, death, or personal injury caused by negligence.
13. Indemnification
You agree to indemnify and hold CAB-X Software Ltd harmless from claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your breach of these Terms
- Your violation of applicable laws
- Your violation of any rights of a third party
14. Termination
CAB-X may suspend or terminate your access to the Service immediately where:
- You breach these Terms
- Payment obligations are not met
- Your use of the Service creates a security risk
- Your actions may harm CAB-X, other customers, or third parties
Upon termination, your right to access and use the Service will end.
Following termination, customers may request an export of their data where technically possible. Data may be deleted after a reasonable period following account closure.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Changes to Terms
CAB-X reserves the right to update these Terms from time to time.
Significant changes may be communicated through the Service or by email.
Continued use of the Service after changes have been published constitutes acceptance of the updated Terms.
